Annotation | This circular sets out the immediate action that health and local authorities should take following the Court of Appeal (CA) judgment on 16 July 1999 in the case of R v North and East Devon Health Authority ex parte Coughlan. The judgment confirms that the NHS has important responsibilities for continuing in-patient care and community health services for people whose primary health need is for health care. The judgment also confirmed that, in appropriate cases, local authorities may purchase the nursing care element of nursing home care, and indicated that guidance on this aspect issued to local authorities in 1992 and 1995, was lawful. A summary of the judgment is included. This is interim guidance: in April 1999, the Government announced a review of continuing care policy and guidance. This circular has been replaced and cancelled by "Continuing care: NHS and local councils' responsibilities" (HSC 2001/015; LAC(2001)18) dated 28 June 2001. (RH). |
