AnnotationThe Data Protection Act 1998 implements the European Directive on the protection of individuals with regard to the processing of personal data, and on the free movement of such data (European Directive 95/46/EC). It also gives effect to the judgment of the European Court of Human Rights (ECHR) in the 1989 case Gaskin v United Kingdom (UK), concerning the right of access to social work records. The Data Protection Act 1998 comes into force on 1 March 2000, when local authorities will have to comply with the "subject access" provisions of the Act. The aim of this draft guidance is to allow social services time to consider their policy on allowing access to records before the Act is implemented. The guidance also covers confidentiality of records, and good practice in record keeping. This circular cancels LASSL(98)16. This circular was cancelled on 1 March 2000 by "Data Protection Act 1998: guidance to social services" (DoH, March 2000). (RH).
