AnnotationThis letter advises local authorities of the latest position following judgments in two judicial review cases. R v Gloucestershire County Council and the Secretary of State ex parte Barry (the "Gloucestershire Judgment") concerns local authorities' responsibilities under Section 2 of the Chronically Sick and Disabled Persons Act 1970 (the CSDP Act) to arrange services for individual disabled people where they are satisfied that it is necessary to meet their needs. R v Sefton Metropolitan Borough Council ex parte Help the Aged and Others (the "Sefton Judgment") concerns needs assessments taking account of a person's capital of less than £16,000 in provision of residential care under Section 21 of the National Assistance Act 1948. The letter refers to a Private Members Bill being introduced by Marsha Singh to amend the 1948 Act, clarifying the legislation. (RH).
