Annotation | Implementation of Parts III and IV of the NHS and Community Care Act 1990 on 1 April 1993 gives local authorities the responsibility to make arrangements for people who need financial support to enter residential or nursing homes. Residents, including those not in receipt of Income Support at that time, will generally have preserved rights to the special higher levels of Income Support under the system existing at that time. Section 21 of the National Assistance Act 1948 gives local authorities powers to make residential accommodation arrangements for people in need of care and attention which is not otherwise available. A subsequent circular, LAC(2001)19, supplements the guidance set out in this circular in respect of preserved rights, particularly that in paragraphs 16, 23 and 24. Both these circulars are now superseded by LAC(2002)7. (RH). |
