AnnotationThese Regulations are the first regulations made under section 22(5) of the National Assistance Act 1948. They make similar provision for the assessment by local authorities of the resources of residents in accommodation arranged under Part III of the 1948 Act, the Social Work (Scotland) Act 1968 or section 7 of the Mental Health (Scotland) Act 1984, to the provision made under the Income Support (General) Regulations 1987 of the assessment of a claimant's resources for income support. These Regulations include general provisions relating to the assessment of a resident's ability to pay; how a resident's income and capital are to be calculated; and liability of relatives for payments. (RH).
