AnnotationThe Mental Capacity Act Deprivation of Liberty Safeguards (MCA DoLS) provide a legal framework to ensure people are deprived of their liberty only when there is no other way to care for them or safely provide treatment. The Safeguards were introduced as an amendment under the Mental Health Act 2007 (but form part of the Mental Capacity Act 2005) and came into force on 1 April 2009. This fourth annual report provides information on uses of the legislation in England during the 2012/13 reporting year. This report also refers to recent Care Quality Commission (CQC) DoLS monitoring. The findings point to a year-on-year increase in applications for deprivation of liberty safeguards: more than half of DoLS applications during 2012/13 were granted. The majority of applications were completed on behalf of people with mental heath conditions (71%); and dementia accounted for more than half of all applications made (53%). (RH)
