It is therefore aimed at those involved with decision making and the rights of those lacking mental capacity, following implementation of the Mental Capacity Act 2005. The book deals with: the mental capacity jurisdiction; lasting powers of attorney; powers of the Court; welfare and healthcare, advance decisions and research; deprivation of liberty safeguards; Court practice and procedure; the Public Guardian and supporting services; and incapacity law in Scotland. The law is stated as at 1 February 2009, but it is likely that the law governing Mental Capacity will continue to develop.
