AnnotationNHS Directions are instructions issued by the Secretary of State for Health who has powers under NHS primary legislation to give directions to health authorities, special health authorities and NHS trusts. These are legally binding and must be complied with by the recipient; see: http://www.dh.gov.uk/en/Publicationsandstatistics/... The Secretary of State gives these Directions in exercise of powers conferred by Sections 8, 272(7) and (8), and 273(1) of the National Health Service Act 2006. These Directions relate to ensuring that an assessment of eligibility for NHS Continuing Healthcare is carried out in all cases where it appears to an NHS body that a patient may have need for such care, in consultation where appropriate, with the social services authority. The NHS body must consult with the patient and, where appropriate, the patient's carer when carrying out the assessment. Also available is a related set of Directions, the NHS Continuing Healthcare (Responsibilities) Directions 2009. The Secretary of State for Health gives these Directions in exercise of the same powers under the National Health Service Act 2006(a) and section 7A of the Local Authority Social Services Act 1970. (RH).
