Annotation | Under the Health and Social Care Act 2008, the legal framework for the regulation of health and adult social care is changing. From April 2010, NHS trusts, existing health and adult social care providers registered with former commissions, and new providers will be required to register with the Care Quality Commission (CQC) in order to be able to operate. To do so, they must show that they are meeting a wide range of essential standards and quality set out under the Health and Social Care Act 2008 (Registration Requirements) Regulations 2009. This draft guidance looks at the proposed Regulations in terms of outcomes and service users' experiences and what is expected of providers to meet outcomes. It covers generic guidance (across health and social care care) on issues such as: respecting and involving people who use services; consent to care and treatment; fees; personalised care, treatment and support (e.g. meeting nutritional needs); safeguarding and safety; suitability of staffing and management; and service quality. Specific guidance is provided that relates to specific services (e.g. hospitals, hospices, mental health and /or learning disability services, care homes, domiciliary care services, supported living services). Appendices include a glossary, a schedule of applicable guidance, and the Health and Social Care Act 2008 (Regulated Activities) Regulations 2009 (Draft). Responses to the consultation on this draft guidance are sought by 24 August 2009. (RH). |
