AnnotationThe European Court of Justice ruling on the High Court's request for a preliminary determination on whether or not the Employment Equality (Age) Regulations 2006 correctly transpose the Equal Treatment Directive in UK law. The reference was made in the course of proceedings between The Incorporated Trustees of the National Council on Ageing (Age Concern England) and the Secretary of State for Business, Enterprise and Regulatory Reform (BERR). The European Court of Justice made the ruling on 5 March 2009, that national rules such as those set out in the Employment Equality (Age) Regulations 2006 fall within the scope of Council Directive 2000/78/EC of 27 November 2000 establishing a general framework for equal treatment in employment and occupation.
