AnnotationThe Ministry of Justice and Department of Health (DH) has produced this consultation on the code of practice and Regulations relating to safeguards being introduced in April 2009 under the Mental Capacity Act 2005. The safeguards are to ensure that people who lack capacity are not deprived of their liberty in either hospitals or care homes, unless there has been a proper authorisation to do so and a review process is in place. Age Concern England (ACE) summarises the key points and recommendations from its response. (RH).
