AnnotationThis briefing details the current position and background to the position of payment of state pensions to those living abroad where there is a legal requirement to do so or where there is a reciprocal agreement in place. A High Court judgment in 2002 and Appeal Court judgment (Annette Carson) in 2003 on this issue found in favour of the Department for Work and Pensions (DWP), confirming the Government's understanding of its legal position. On 26 May 2005, the Appellate Committee of the House of Lords delivered its judgment on the case and found in favour of the Government. There are no plans to make any changes to the current arrangements which allow for the exportability and uprating of UK State Pensions. (KJ/RH).
