| Annotation | This booklet provides introductory information on the Mental Capacity Act 2005, and covers issues relating to the person being cared for and that individual's capacity to make decisions about money, health and other matters. It briefly explains Lasting Power of Attorney (LPA, previously Enduring Power of Attorney, EPA); the role of a Deputy; the new Court of Protection; the Office of the Public Guardian; and issues around refusing or requesting treatment and care. However, the booklet is not a statutory Code of Practice issued under the Act, and is not a guide to how the law will apply in specific situations. The publisher, the Mental Capacity Implementation Programme (MCIP), is a joint government programme between the Department for Constitutional Affairs (DCA), the Department of Health (DH), the Public Guardianship Office (PGO) and the Welsh Assembly Government. The booklet was written by a team from the Making Decisions Alliance - in this instance from Sense, the Alzheimer's Society, Age Concern and Turning Point. (RH). |
