Annotation | Age Concern England (ACE) questions the current interpretation of Section 6(3)(b) of the Human Rights Act 1998, which fails to distinguish between services contracted by a public authority to meet its statutory duties, and services merely funded by the public sector. ACE first expressed concern to the first inquiry by the Joint Committee on Human Rights in relation to the Leonard Cheshire case in the Court of Appeal. ACE believes that it is unacceptable that older people who are dependent on public services delivered by independent sector providers have no redress for abuses of their human rights.
