AnnotationThe Mental Capacity Act 2005, which comes into force in April 2007, will have a Code of Practice. Age Concern England (ACE) comments on the Code's clarity and style, but especially on Chapter 3 which is about deciding on capacity. ACE will be recommending to the Department of Health (DH) that revised National Minimum Standards should refer specifically to care being provided in accordance with the Code of Practice.
