AnnotationThe Care Record Guarantee sets out the commitment of the National Health Service (NHS) in its use of patient information as the health service in England moves towards a national electronic records system - the NHS Care Records Service. Patients have the right to confidentiality under the Data Protection Act 1998, the Human Rights Act 1998 and the common law duty of confidence (the Disability Discrimination and the Race Relations Acts may also apply); and to ask for a copy of all records about themselves (a fee may be payable). There is a brief description about the NHS Care Records Service (established 2004) and its progress to date. Rights of patients are given in 12 stated commitments; and the responsibilities of the patients are contained in 6 stated principles. Plans for the future of the NHS Care Records Service are outlined. There is also a four page introductory document to the Care Record Guarantee. This is a revision of the document which was first published in 2005, and which is to be regularly reviewed following feedback to the Care Record Development Board and its successor body, the National Information Governance Board for Health and Social Care (NIGB).
