AnnotationThis information sheet explains the decision by Ministers to abolish the downrating rule. Hospital downrating rules have applied to most social security benefits since 1948, and so this change will provide significantly more money to most people. From April 2006, the majority of people (with the exception of detained in-patients under the Mental Health Act 1983) who have been in full time NHS funded care for more than 52 weeks, will have their DWP benefit restored to the full rate from their first payment day, on or after 10 April 2006. This also includes people in independent sector care homes who are receiving continuing NHS care. In addition to this, anyone who entered hospital after April 2005 will not have their benefit downrated after 52 weeks. See the DWP website for further information on the Hospital Downrating changes.
