AnnotationThe Department of Health (DH) has consulted on proposals to change legislation as a consequence of the European Court of Human Rights (ECHR) ruling HL v the United Kingdom (known as the Bournewood judgment). The Government has accepted that additional procedural safeguards are necessary in order to meet Human Rights requirements. The case involved a person who lacked mental capacity, was not subject to the mental health legislation and who was considered by the ECHR to have been deprived of his liberty. Age Concern's response to this consultation centres on its concerns that older people in hospital and care homes do not have adequate safeguards against deprivation of liberty, particularly for those who lack capacity.
