Annotation | Paragraph 11 of Schedule 5 of the Housing Act 1985 provides that the right to buy does not arise if a property is particularly suitable for occupation by older people and had been let for occupation by a person who was aged 60+. This Circular provides an overview of the procedure for dealing with appeals from tenants against being denied the right to buy under Paragraph 11. It provides revised guidance to landlords on the criteria which the Secretary of State will normally expect to be satisfied when determining whether a property has been correctly excluded from the right to buy under Paragraph 11. (RH). |
