Annotation | This Government Bill was first introduced in session 2003/04 and has been carried over into session 2004/05. If enacted, it will make new provision relating to individuals who lack mental capacity. It establishes a superior court of record called the Court of Protection in place of the office of the Supreme Court of the same name. There will also be an officer, the Public Guardian, among whose functions will be to establish and maintain a register of lasting powers of attorney. The Bill makes provision in connection with the Convention on the International Protection of Adults signed at the Hague on 13th January 2000. Explanatory notes on the Bill, prepared by the Department for Constitutional Affairs (DCA), are published separately as EN-1. (RH). |
