AnnotationThis is the first issue of the Office of Fair Trading's guide to potentially unfair terms in agreements made by care homes with older people. A first draft guide was published as an annex to the OFT's 1998 report, "Older people as consumers in care homes". This guide is based on a review of a sample of agreements and the OFT's experience of enforcing the Unfair Terms in Consumer Contracts Regulations 1999 (SI 1999/2083). It explains the test of unfairness set out in the Regulations; sets out the main areas of concern; and discusses the types of unfair term listed in Schedule 2 of the Regulations, also additional categories of unfair terms that are not. An annex contains some examples of unfair and revised terms. (RH).
