Annotation | On 18 February 2003, the Department of Health (DH) published the amended National Minimum Standards for Care Homes for Older and Adults 18-65. The standards were heralded as a "government U-turn". This article concludes that, for the first time, it appears to have been accepted that the national minimum standards (usually referred to as the National Required Standards, or NRS) are not in themselves enforceable. Significantly, the requirements of the Care Standards Act 2000 and associated regulations can be complied with by means other than those set out in the standards. The shift in respect of the application of the standards as a whole will prove to be more significant than the abolition of a set physical environment standards that were never enforced. This article summarises the amendments to the standards, which were due to come into force on 1 June 2003, replacing the original March 2001 standards. (RH) |
