AnnotationThere is confusion regarding administrative changes to continuing care. Between them, the National Health Service (NHS) and the Department of Health (DH) have contrived to dilute the NHS's responsibilities. The effect of these changes has been that at any one time, there are some 25,000 people paying for places in nursing homes who 20 years ago would have received free care from the NHS. Following the Court of Appeal judgment in the Coughlan case, guidance from the DH on free nursing care should have resolved the matter. Rather, it would appear that this guidance confirms the status quo, thus undermining the fundamental care entitlement. (RH).
