Annotation | Section 17 of the Health and Social Services and Social Security Adjudications Act 1983 give councils a discretionary power to charge adult recipients of non-residential services. However, problems with variations in home care charging policies between local councils were identified in the report of the Royal Commission on Long Term Care (1999) and in the Audit Commission report "Charging with care" (2000). This statutory guidance is issued under section 7 of the Local Authority Social Services Act 1970 and under the Care Standards Act 2000. The aim is to help councils who decide to charge for any non-residential services, to design reasonable and fair charging policies; and regard should be paid to the effect of any charge on a user's net income.
