AnnotationThese Standards were published on 3 March 2001 by the Secretary of State (SOS) for Health under s23(1) of the Care Standards Act 2000 (CSA) and are likely to come into force on 1 April 2002. S23 gives powers to the SOS to publish Standards which the National Care Standards Commission (NCSC) "shall take into account" when making its decisions. DLA considers that the Standards are not regulations which are legally binding, but in practice, it appears there will be very little difference between the two, particularly as the registered person will be required to show he/she is meeting the requirements of the CSA and the Regulations by showing that the Standards for that client group are being met. It goes on to give further legal consideration of the Standards, with some explored in more detail. (KJ).
