AnnotationThis proposed draft of the Transitional and Savings Provisions Commencement Order under the Care Standards Act 2000 sets out the transitional arrangements for different groups of providers who will be registered under Part II of the Act by the National Care Standards Commission (NCSC). These groups include: all providers currently registered or licensed; registration and inspection units; care homes and nurse agencies; and managers of nursing homes who were previously exempt from registration who will be required to apply for registration from January 2002. A "non-regression" provision will make it a condition of registration that care home providers keep room sizes at levels no lower than those in place at 31 March 2002 until the transitional period on space standards ends in 2007. Views on the draft Order are sought, by 5 October 2001, on whether the transitional provisions are appropriate, proportionate and reasonable; and whether there are any issues not included in the provisions that need to be considered. A separate consultation covers fees and inspection frequencies. (RH).
