AnnotationAlthough the legal structure identified in the 1996 edition "Community care for older people: rights, remedies and finances" is still in place, there is a more extensive legal literature coupled with changes in policy. This book sets out the law as at the end of February 2001, including details of the Health and Social Care Bill (session 2000/01) with regard to the Government's response to the Royal Commission on Long Term Care. The focus is on the legal rights and duties to receive or provide care and the costs of care, from the perspective of the older client and his or her legal adviser. Rights and duties are covered in chapters on: the policy framework for long-term care; NHS responsibilities for long-term care; discharge from hospital; local authority services; the assessment of needs and provision of services; and residential care services. Costs of care are considered as follows: public funding for long-term care; paying for non-residential services; the local authority means test for residential care; treatment of the resident's former home; preserving assets; using benefits to fund residential care; and preserved rights to Income Support.
