AnnotationHow decisions can be made on behalf of mentally-incapacitated adults has been subject to some scrutiny in recent years. This paper updates a 1996 article, "Ethical aspects of the Law Commission report on mental incapacity" in this journal. It considers recent Government proposals in the light of another Law Commission report, "Making decisions" (Cm 4465). Although there are aspects of the report to be welcomed, the Government has decided to avoid contentious issues: advanced statements in health care; public law protection of those at risk; and non-therapeutic research.
