Annotation | The Human Rights Act 1998 comes into force on 2nd October 2000. In essence, the Act incorporates into UK law the European Convention on Human Rights (ECHR) to which the UK has been party since 1951. This means that people will have the opportunity to have disputes about their rights determined by UK courts instead of having to have cases taken to Strasbourg. How provision of public health care in the UK may change to meet the Act's demands and a rights culture is a matter for conjecture. This paper is by way of a background briefing on the Act's likely impact, and includes references to relevant case law. The paper concludes with questions concerning how the National Health Service (NHS) will need to respond to the Act as a whole. (RH). |
