AnnotationThe Data Protection Act 1998 (DPA) came into force on 1 March 2000, and repeals the Data Protection Act 1984, the Access to Personal Files Act 1987, and most of the Access to Health Records Act 1990. This guidance to local authority social services provides information about how the DPA works in relation to giving access to social work records. It provides good practice guidance in compiling and maintaining records: authorities having well-maintained records will find it easier to comply with the requirements of the Act. The guidance also gives advice on the need for policies covering retention and disposal of other records, as well as guidance on confidentiality and social services records. Also included are a glossary of terms used in the Act, principles of data protection, and text of the Data Protection (Subject Access Modification) (Social Work) Order 2000 (which concerns partial exemptions from provisions of the DPA). This guidance replaces the following Department of Health (DoH) circulars, which are therefore withdrawn: LAC(87)10, LAC(88)16, LAC(88)17, LAC89(2), LASSL(98)16, and LASSL(99)16. (RH).
